Terms of Use of Applications
These Terms of Use of Applications ("Terms") apply to your installation and use of applications on orkut. Applications are additional features that can be added to an orkut profile to customize the orkut experience, typically created by third-party developers rather than Google. Your use of the applications available through orkut is governed by the Google Terms of Service (including without limitation all disclaimers and limitations of liability contained therein) as well as these additional Terms. Data Sharing through Applications By adding an application to your profile, your public profile information will be shared through the application with its developer, with your friends who receive your updates on orkut, and with any other viewer or user of the application whether that viewer or user is on orkut.com or another website where the application appears (collectively, "Data Recipients"). By "public profile information", we mean all information that is available on your profile that does not have a privacy setting that limits access to friends of friends, friends, or yourself. This includes content such as photos and videos. When you add an application to your profile, your orkut friends' profile names, profile URLs and profile picture (all of which are public profile information) also will be shared with the Data Recipients. Likewise, when one of your friends adds an Application to their profile page, your public profile name, profile URL and profile picture will be shared with the Data Recipients, even if you have not added that application to your profile. Only your profile information that is available to "everyone" will be available through the application. If you adopt an application and then later change the privacy setting for one of your profile fields from "everyone" to "friends" or another limited setting, the application will no longer obtain that information on future calls. However, please be aware that Data Recipients may have received that information before you changed the privacy setting, and may continue to maintain that information that they previously viewed or stored. Profile information that you have limited to friends of friends, friends, or yourself at the time of adding the application will not be shared through the application. If you later change your privacy settings to make that information available to "everyone", then that information may become available to the Data Recipients. After you have added the application to your profile, the application will obtain information about which profile and canvas pages you visit on orkut that contain the same application. Third Party Development of Applications You understand and agree that the majority of the applications available in the orkut application directory are created by third-party developers, not Google. You acknowledge and agree that Google does not assume any liability or responsibility for the content or performance of any third-party developed applications, nor for the third party's use of your information, nor for any developer's actions. Google does ask each developer to agree to the Developer Terms of Service when adding an application to the orkut application directory. You acknowledge and agree that Google is not liable for any loss or damage which may be incurred by you as a result of your use of or inability to use an application developed by a third party, or as a result of any reliance placed by you on the completeness, accuracy or existence of any products or other materials on, or available through, such applications. You understand and agree that you install and/or use all applications at your own risk. Google reserves the right (but shall have no obligation) to pre-screen, review, flag, filter, modify, refuse or remove any or all applications (or content available through such applications) at any time for any or no reason. Unless you have been specifically permitted to do so in a separate written agreement with Google and/or the developer of the application, you agree that you will not copy, sell, trade or resell any application for any purpose. Changes to these Terms of Use of Applications Google may make changes to these Terms of Use of Applications from time to time. When these changes are made, any new terms will be made available to you at this URL. You understand and agree that if you use the Services after the date on which these Terms have changed, Google will treat your use as acceptance of the updated Terms.
